First Advantage Background Check

The Rights You Have During a First Advantage Background Check

According to the Fair Credit Reporting Act (FCRA), First Advantage is a consumer reporting agency (CRA), as previously mentioned. As a result, you have certain legal rights under the FCRA, and FADV has certain legal obligations, along with similar state regulations, including the following:

The privilege of only undergoing background checks that are approved. Before completing any background reports, your express consent must be obtained. FADV becomes liable and violates the FCRA if consent is not obtained.

The right to truthful information in reports you receive, as well as any future ones produced using your customer data.
the ability to see and obtain any consumer report that has been done on you. A copy of any reports generated using your data must be sent to you by FADV or any other CRA.

The right to be informed about the precise details of a report that were used to reject your application for a job, a place to live, or other opportunities.

The freedom to request and free of charge review your credit report once a year from each of the three credit bureaus (TransUnion, Equifax, and Experian). It is advisable to thoroughly examine your credit profile even though it might not apply to every data dispute (like a dispute involving a criminal conviction), in the event that your background check reveals mistakes in your credit or rental history.

The ability to contest erroneous, deceptive, or fraudulent information in your report. In certain cases, even the inclusion of factually accurate information may violate your rights because the state has prohibited the inclusion of certain information (such as a criminal history that predates the look-back period).

The ability to sue for error correction and compensation if you are harmed financially, emotionally, or in any other way as a result of inaccurate reporting, poor investigation work, or a failure to make amends. Furthermore, a lawsuit may be supported by false reporting of specific data even in the absence of proof of actual harm (e.g., a consumer may be falsely reported as dead when they are actually alive and well).
